We know from our own experience in buying property in Mexico that one of major concerns for the buyer is the question of how to set up ownership and if the property you are considering has a clear and unencumbered title. We strongly recommend that you hire an attorney to research the title of any property you are interested in buying and to represent you in the buying procedure, just as you would if you were buying property closer to home.

In our situation we had 3 partners investing in this property. We decided that for us, setting up a Mexican corporation was the best choice so when we purchased the property, we created ANSYL S.A. DE C.V. and that corporation owns 100% of the property. And the 3 partners own 100% of the stock of ANSYL. In effect, we own the property outright as apposed to setting up a long term trust (known as a fideicomisario) which is administered by a bank . There are plusses and minuses for both forms of ownership and that decision is up to the buyer. You may decide that setting up a fideicomisario makes the most sense for you. In our case, the fact that the corporation could own 100% of the property was one positive but it was not the only reason we decided to go the Mexican corporation route.

When you do buy, one document that the notary will require before he will complete the registration of the title is known as the CERTIFICADO DE LIBERTAD DE GRAVÁMEN. While the literal translation of this is Certificate of Free of Tax it actually indicates that not only are the taxes current on the property but also that there is no lien or encumbrance of any kind related to the title of the property as well.
